Terms of Use

1. General Terms of Use

Users must agree to the terms before using FIXIE services. This includes acknowledging platform rules, privacy policy, and any updates. Accessing the platform signifies agreement.

Acceptance of Terms:

Users must agree to the terms of use before accessing FIXIE’s services. This includes acknowledging the platform's rules, privacy policy, and any updates to the agreement. Users signify agreement by accessing or using the platform.

Eligibility:

Users must be at least 18 years old or the legal age of majority in their jurisdiction and capable of forming legally binding contracts. The platform is not intended for use by minors.

Scope of Services:

FIXIE acts as an intermediary connecting service requestors with service providers. It does not directly perform services but facilitates bookings, payments, and communication. The platform may also provide tools for service providers to manage jobs, schedules, and client relationships.

Modifications to Terms:

FIXIE reserves the right to unilaterally modify the terms of use, with notice provided to users (e.g., via email or in-app notifications) or without notice in certain circumstances. Users are responsible for reviewing updates.

2. User Responsibilities

Homeowners (Service Requestors):

  • Accurate Information: Homeowners must provide accurate details about the job (e.g., type of service, location) and ensure access to the property at the agreed-upon time. They are responsible for ensuring the property meets any site requirements (e.g., safe access, no hazards like uncrated pets).
  • Consent for Third-Party Content: If homeowners upload content (e.g., photos of issues, manuals, or property details), they must have the legal right to do so, especially if it involves third-party information or intellectual property.
  • Payment Obligations: Homeowners agree to pay for services through the platform, upon completion using approved payment methods (e.g., credit card, digital payments or cash). Late payments may incur interest or collection fees.
  • Conduct: Homeowners must interact respectfully with service providers and comply with platform policies.

Service Providers:

  • Qualifications and Conduct: Providers must be vetted, licensed (for specific services), and maintain professional standards. They are responsible for assessing job requirements or performing services as agreed.
  • Independent Contractor Status: Providers are independent professionals, not employees of FIXIE. No agency, partnership, or employment relationship is created between FIXIE and providers.
  • Liability for Services: Providers are solely responsible for the quality of their work and bear primary responsibility for resolving issues.
  • Compliance with Laws: Providers must comply with local licensing, tax, and labor regulations.

3. Fees and Charges - Service Providers

Platform Fee

FIXIE charges Service Providers a platform fee (“Platform Fee”) for each successfully completed service transaction conducted through the platform. The Platform Fee shall be calculated as a percentage of the total service amount paid by the Service Requestor, unless otherwise specified in writing by FIXIE.

Allowances and Promotional Adjustments

FIXIE may, at its sole discretion, offer temporary fee reductions, promotional allowances, incentives, or alternative pricing structures to selected Service Providers or categories of services. Such allowances shall be subject to specific terms communicated at the time of the offer and may be modified or withdrawn at any time unless expressly stated otherwise.

Additional Charges

FIXIE may introduce additional charges related to payment processing, subscription plans, premium visibility features, advertising, lead generation, or other optional services. Service Providers will be informed of applicable charges prior to incurring them.

Taxes

Service Providers are solely responsible for all taxes, duties, levies, and statutory contributions arising from income earned through the platform, unless otherwise required by law.

Right to Modify Fees

FIXIE reserves the right to modify the Platform Fee, introduce new fees, or amend existing charges at any time. Any changes shall be communicated in advance through the platform or via registered communication channels. Continued use of the platform after such notification constitutes acceptance of the revised fees.

Deductions and Set-Off

FIXIE is authorized to deduct applicable fees and charges directly from payments collected on behalf of the Service Provider before remittance.

4. Cancellation Policy

General Principle

FIXIE aims to ensure reliability and fairness for both Service Providers and Service Requestors. Once a service request has been accepted by a Service Provider, both parties are expected to honor the commitment.

Provider-Initiated Cancellation

If a Service Provider cancels an order after accepting it, a cancellation penalty may be applied. The cancellation penalty may include, but is not limited to:

  • A fixed monetary deduction;
  • Temporary suspension of account privileges;
  • Reduction in visibility or ranking within the platform;
  • Permanent account termination for repeated offenses.
FIXIE reserves the right to determine the appropriate penalty based on factors including frequency of cancellations, timing, and impact on the Service Requestor. Repeated cancellations may result in account suspension or termination.

Consumer-Initiated Cancellation After Provider Commute

If a Service Requestor cancels an order after the accepted Service Provider has begun commuting to the agreed service location, a cancellation fee shall apply.
At the time of cancellation, the Service Requestor will receive a clear warning notice stating that cancellation at this stage may result in a penalty.
If the Service Requestor proceeds with cancellation after receiving the warning:

  • A cancellation fee may be charged;
  • The fee may include compensation for time, travel, or opportunity cost incurred by the Service Provider;
  • The amount shall be determined in accordance with Fixie’s applicable fee schedule.

Determination of Commencement of Commute

For the purposes of this policy, “commencement of commute” shall be determined based on platform-tracked status updates, provider confirmation, GPS tracking (where applicable), or other reasonable evidence as determined by FIXIE.
Fixie reserves sole discretion in determining whether a provider has begun commuting.

Exceptions

FIXIE may waive cancellation penalties in cases involving:

  • Verified emergencies;
  • Safety concerns;
  • Force majeure events;
  • System errors or platform malfunctions.
Requests for waivers must be submitted to FIXIE support with appropriate documentation. FIXIE reserves the right to approve or deny waiver requests at its sole discretion.

Right to Modify
